Terms of Service

These terms apply to businesses ("you") that use ChadaFactoria, a cloud contact-center service owned and operated by Solodolos Technologies Limited ("we", "us"). By creating an account or using the service you agree to them on behalf of your business.

The service

ChadaFactoria lets your team answer customers by phone, live chat, SMS, email and WhatsApp, and keep records of those conversations. Phone numbers and messaging are provided through our telecommunications partners and remain allocated to us; we make them available to your account while it is active.

Your account

• You are responsible for the people you invite and for what they do in your account.
• Keep sign-in details private, and tell us straight away at [email protected] if you think your account has been misused.
• You must have the right to give us the customer information you store in ChadaFactoria, and you must tell your customers how you use it, including call recording where the law requires.

Recording, transcripts and AI

You choose whether calls are recorded and transcribed, the notice callers hear, and how long recordings are kept. You are responsible for getting any consent the law requires where you and your callers are, and for telling callers about recording and transcription. Transcripts may be analysed by AI to show how a customer seems; these readings are an aid for your team and may be wrong, so don't rely on them alone for decisions about a person.

Acceptable use and anti-spam rules

ChadaFactoria is for conversations with people who want to hear from you. You must not use it to:

• send unsolicited, bulk or marketing email, SMS or WhatsApp messages, or messages to purchased, rented, scraped or imported lists;
• contact anyone who has asked you to stop, or ignore unsubscribe and opt-out requests;
• send messages from a domain or phone number you do not own or are not authorised to use;
• make calls or send messages that break telemarketing, robocall, consent or privacy laws where you or the recipient are located;
• send anything fraudulent, deceptive, harassing, illegal, or that contains malware or phishing;
• try to access other businesses' data, overload the service, or get around its security or limits.

Email sent through ChadaFactoria is limited to replies to customers who contacted you and account emails to your team. Addresses that bounce or report spam are suppressed automatically. We may suspend sending, or your account, without notice if we see a breach of these rules, and we may report illegal activity to the authorities.

Fees, trials and payment

New accounts get a 14-day free trial. Fees are shown when you subscribe and are billed in advance, per agent, unless agreed otherwise. Usage such as call minutes and messages is billed as used. Charges on your statement will appear as CHADAFACTORIA.com. If payment fails we may limit the service after giving you notice.

Your data

Your customer data belongs to you. We process it only to provide the service, as described in our Privacy Policy. You can export it at any time while your account is open. After you close your account we delete it within 90 days, unless the law requires us to keep part of it.

Availability and changes

We work to keep ChadaFactoria available and secure, but we cannot promise it will be uninterrupted or free of errors. We may improve or change features; if a change significantly reduces what you pay for, we will tell you in advance.

Liability

To the extent the law allows, we are not liable for indirect or consequential losses, lost profits or lost data, and our total liability under these terms is limited to the fees you paid us in the 12 months before the claim. Nothing in these terms limits liability that cannot be limited by law.

Ending the service

You can close your account at any time. We may suspend or end your account if you seriously or repeatedly break these terms, or do not pay.

Changes to these terms

We may update these terms. We will change the date above and tell account administrators about important changes before they take effect.
